성소수자 권리, 진지하게 논의할 때다

성소수자 부부가 최근 “동성이라는 이유로 배우자의 건강보험 부양 자격을 박탈당한 것은 부당하다”며 국민건강보험공단을 상대로 행정소송을 냈다가 패소했다. 서울행정법원은 “혼인이란 남녀의 결합을 근본 요소로 한다고 판단되며 동성 간의 결합까지 확장해 해석할 만한 근거가 없다”고 판결 이유를 밝혔다.현재 우리나라는 법적으로 동성혼을 인정하지 않고 있다. 사회적 인식 면에서도 동성혼에 대해 부정적인 시각이 존재한다. 이에 법원도 “민법과 대법원 판례, 우리 사회의 일반적인 인식을 모두 모아 보더라도” 동성혼을 인정할 수 없다고 했다.성소수자는 법적 권리 외에 여러 가지 차별을 받고 있다. ‘성소수자는 당신의 일상 속에 있습니다’라는 내용의 광고가 지하철에 게시됐다가 훼손되는 일도 있었다. 성소수자 차별은 한국에서만 일어나는 일은 아니다. 러시아는 성소수자의 집회·결사의 자유를 보장하지 않고 있다. 터키 이스탄불에선 성소수자 퍼레이드를 경찰이 무력으로 해산시켰다.성소수자의 권리와 관련해 차별금지법 제정 논의가 여러 차례 있었다. 지난해 6월에는 청와대 국민청원에서 차별금지법 제정 청원이 10만 명의 동의를 얻었다. 국가인권위원회가 실시한 설문조사에선 응답자의 70% 이상이 성소수자도 동등한 대우를 받아야 한다고 답했다. 차별금지법에 반대하는 목소리도 높다. 하지만 성소수자에 대한 차별이 ‘성별과 종교에 의해 차별을 받지 아니한다’고 한 우리 헌법의 취지에 어긋나는 것은 아닌지 생각해 볼 필요가 있다.소현정 생글기자 (염경중 3년)

How to Reduce Homophobia in Korea

Since the WHO removed homosexuality from its list of diseases in 1990, the developed world has been exhibiting more tolerance to the LGBTQ community than ever. However, South Korea remains LGBTQ-unfriendly despite its recent UNCTAD classification as a developed country.The grounds behind Korea’s stunt growth in LGBTQ tolerance may be of the following reasons.Christianity is a common cause of homophobia not only in Korea but in many countries. If there is a difference, religious groups in South Korea are highly influential in the political world. This discourages politicians from pursuing LGBTQ-friendly policies such as the anti-discrimination law.Confucianism is deeply rooted in Korean society, influencing many parts of life ranging from moral precepts to family traditions. This causes the Korean society to be less tolerant of LGBTQ culture mainly because of concerns about ‘keeping the family intact’.The model of an ideal family in the Confucian value system is highly patriarchal. The son becomes the ‘head of the household’ once his parents grow old, becoming responsible for taking care of his parents and siblings as the ‘breadwinner’ of the family. However, many view gay or transgender individuals as incapable of this position since they are considered financially unstable and incapable of social success.Another influencing factor is that LGBTQ identity evades core Confucian values related to filial piety. A famous quote from 《The Classic of Filial Piety》, “身體髮膚 受之父母 不敢傷 孝之始也”, states that “Your body, including hair and skin, is what you inherited from your parents; preserving them is the beginning of your duty towards them.” In the context of this teaching, ‘changing’ the gender genetically inherited from your parents can be considered a serious disrespect towards them.South Korea needs more laws that restrict the lobbying of religious groups.
